Case 22-00836/22-E-0236 (Proceeding to Establish Alternatives to Traditional Demand-Based Rate Structures for Commercial Electric Vehicle Charging)

The New York State Public Service Commission (Commission) today approved a series of incentives, programs and tariffs designed to reduce the utility bills for commercial electric vehicle (EV) charging, which includes fleet charging and public fast charging stations. The solutions are designed to reduce the impacts of demand charges on the operating costs for EV charging stations, particularly in the near-term when EV adoption is still growing.

The Commission’s action today directs the utilities to develop three different 
solutions that are alternatives to traditional demand-based rates. First, the utilities will develop a demand charge rebate that provides a 50 percent demand charge credit for all commercial EV charging-use cases. 

Second, Con Edison and O&R will implement a commercial managed charging program that provides use-case specific incentives in lieu of the demand charge rebate, as well as value-based bill credits that provide operating costs relief for EV charging stations that are able to avoid charging during the costliest times for the grid. The remaining upstate utilities will propose commercial managed charging programs within 180 days, allowing more time to develop their programs.

Third, the Commission adopts the EV phase-in rate proposed in the staff whitepaper, which begins as a time-of-use rate, and blends in a demand charge as charging station utilization improves.

The New York State Public Service Commission (PSC) authorizes the Demand Charge Rebate program to provide operating cost relief for commercial EV charging customers. Investor-owned utilities must file plans with the PSC to implement a series of programs provide demand charge relief for EV charger operators, terminate per-plug incentive programs, and implement a commercial managed charging program. EV charging customers would receive an off-bill rebate equivalent to 50 percent of applicable EV charging demand.

Governor Hochul Announces $12.6 million in Community Environmental Education Center Grants

Governor Hochul announced more than $12.6 million in Community Environmental Education Center grants. Through the awards, 11 community-based organizations will construct new or improve existing environmental education centers in environmental justice and disadvantaged communities. The grants are administered by the New York Department of Environmental Conservation’s (DEC) Office of Environmental Justice, and represent the largest funding awarded for any single environmental justice grant opportunity. DEC receives funding from the State’s Environmental Protection Fund, which received a record $425 million from the 2025-2026 state budget.

S. 8012/A. 8332: Relates to the assessment of solar or wind energy systems

New York Senate Bill 8012/Assembly Bill 8332 amends the real property tax law governing the assessment of solar and wind energy systems. The bill requires that host community benefit payments, decommissioning expenses, and community solar subscriber management costs be included as expenses when calculating property valuations. Federal investment and production tax credits and renewable energy credits must be excluded from revenue stream calculations.

Establishes the Smart Growth Community Planning Program, funded through the state's Environmental Protection Fund.

The New York State Department of State's Smart Growth Community Planning Program is administered by the Office of Planning, Development & Community Infrastructure. The program awards funds to eligible communities for the development or update or local and countywide comprehensive plans, areas plans or zoning codes that emphasize and integrate Smart Growth principles, including: 
 

- Develop plans and land use regulations that allow for and encourage mixed-use neighborhoods.
- Enable a diverse mix of housing types, providing opportunity and choice for people of all ages, abilities and incomes.
- Prioritize infill and redevelopment of existing buildings to revitalize neighborhoods and downtowns, including areas around public transit.
- Provide well-planned, equitable, age-friendly and accessible public spaces.
- Encourage compact neighborhood design and concentrated development around existing infrastructure.
- Preserve open space, agricultural resources, and natural resources.
- Prioritize transportation options such as walking, cycling, and public transportation.
- Promote climate resiliency and adaptation, preferably through nature-based solutions, and reduce greenhouse gas emissions.
- Build on unique traits to create an attractive and welcoming community with a strong sense of place.
- Engage in an inclusive, collaborative public planning process that considers the needs and character of the community.
- Design places that are accessible to people of all ages and abilities, with amenities that meet and ideally exceed base ADA compliance, particularly in the public realm.
