Executive Directive No. 2023-5

Today I order the appropriate state agencies to begin the process of converting vehicles owned and used by the state—the state fleet—to zero emission vehicles, with a goal of completing that conversion by 2033 for light-duty vehicles and 2040 for medium- and heavy-duty vehicles. This will reduce greenhouse-gas emissions, boost demand for Michigan automakers’ ZEV production, and reduce the overall costs of the state fleet.

The Executive Order sets the following minimum targets regarding use of ZEVs in the state's fleet:

- Conversion of light-duty vehicles in the state fleet to ZEVs by 2033; and
- Conversion of medium- and heavy-duty vehicles in the state fleet to ZEVs by 2040.

HB 5120

House Bill 5120 amends the Clean and Renewable Energy and Energy Waste Reduction Act to create a certification process, through the Michigan Public Service Commission (MPSC), for wind, solar, and energy storage facilities with specified capacities. Generally speaking, the MPSC certification process preempts local regulation of those facilities, although a local government with an ordinance whose requirements do not exceed the bill’s certification standards can act as a permitting authority in some circumstances.

HB 5121

House Bill 5121 amends the Michigan Zoning Enabling Act to make zoning ordinances subject to House Bill 5120, which creates a certification process for wind, solar, and energy storage facilities with specified capacities.

SB 277; Solar Facilities under Farmland Development Rights Agreements

Guarantees farmers can utilize their properties as they see fit by ensuring that solar facilities are permitted uses for farmland under a development rights agreement under the state’s Farmland and Open Space Preservation Act.

The Executive Order directs the Department of Technology, Management, and Budget to prepare a Zero Emission Plan (ZEP) that supports conversion of the state fleet to zero-emission vehicles. The ZEP shall include:


- Fleet replacement schedules;
- EVSE siting and build-out plans;
- Program management plan and requirements;
- Operations and maintenance plan for ZEVs and EVSE; and
- Anticipated funding needs.
