Accessory Dwelling Unit Policy Task Force Final Report

​During the 2023 ses​sion, the Mary​land Gen​eral Assembly passed SB 382 (sponsored by Senator Mary Washington​​), which was enacted into law on May 28, 2023. The bill established the Accessory Dwelling Unit Policy Task Force (Task Force) to study the placement of accessory dwelling units (ADU) on land zoned for single-family residential use and to survey and document a representative sampling of the variety of ordinances, laws, codes, and policies regarding accessory dwelling units at the state and local level. The Task Force also studied best practices for streamlining or standardizing the local ADU application and development review process.

This report included the findings and recommendations describing potential issues with current ADU regulations in Maryland, the process to prepare and adopt local ADU regulations, which zoning districts should allow ADUs, and whether such regulations could result in new ADUs. Other information addressed measurable results, local permitting, lessons learned, and potential impacts on local housing markets and neighborhood character. Local best practices were also compiled and explained, providing guidance for jurisdictions wishing to adopt ADU regulations. Finally, the report included​ recommendations to the governor and general assembly related to state and local-level legislation impacting ADUs.

HB 1466: Land Use and Real Property - Accessory Dwelling Units - Requirements and Prohibitions

This bill establishes a State policy to promote and encourage the creation of accessory
dwelling units (ADUs) on land with a single-family detached dwelling unit as the primary
dwelling unit, to meet housing needs. The bill also (1) requires adoption of specified local
laws authorizing ADUs; (2) prohibits a restriction on use of a property from unreasonably
limiting the ability of an owner to develop or offer for rent an ADU; and (3) authorizes
homeowners associations (HOAs) to treat an ADU as a separate lot for purposes of voting
and assessments.


Maryland Zero Emission Vehicle Infrastructure Plan

The Maryland Department of Transportation (MDOT) and the Maryland Energy Administration (MEA) are working collaboratively with partners and stakeholders to develop the Maryland State Plan for National Electric Vehicle Infrastructure (NEVI) Formula Funding Deployment, and the subsequent NEVI program. The plan is required by the Bipartisan Infrastructure Law (BIL), enacted as the Infrastructure Investment and Jobs Act (IIJA), to access NEVI formula program funding. The NEVI Plan was submitted to the Federal Highway Administration (FHWA) on July 15, 2022, in advance of the federal deadline of August 1, 2022.

As part of Zero Emission Vehicle Infrastructure Plan (ZEVIP), the Maryland Department of Transportation (MDOT) developed a set of suitability analysis tools to support investment of electric vehicle (EV) charging infrastructure in Maryland. These tools build upon MDOT’s previous work under the National Electric Vehicle Infrastructure (NEVI) Program and the EV Charging Siting Tool to identify areas within Maryland best suited for charging infrastructure. 



- EV Corridor Charging:
The EV Corridor Charging Suitability Tool supports the investment of Direct Current (DC) Fast charging infrastructure along Maryland’s 23 designated EV Alternative Fuel Corridors (AFCs) in order to build redundancy within Maryland’s EV charging network.

- Neighborhood & Amenity EV Charging:
The Maryland Neighborhood and Amenity EV Charging Suitability Tool supports the deployment of publicly available light-duty EV charging infrastructure within Maryland communities where people gather or currently stop in order to increase equitable access to publicly available EV charging infrastructure.

- High Density Residential EV Charging: 
The High Density Residential EV Charging Suitability Tool prioritizes the deployment of publicly available light-duty EV charging infrastructure adjacent to Multi-Unit Dwellings (MUDs) as well as prioritizes curbside charging needs for urban and nonurban communities that do not have dedicated driveways or home garages in order to increase equitable access to charging.

- Workplace EV Charging:
The Workplace EV Charging Suitability Tool facilitates convenient charging access for employees at dedicated work locations by provide charging for drivers with limited or no access to at-home charging and long commutes.
